These Terms & Conditions (“Terms”) govern your access to and use of WOO websites, mobile applications, software, and related services (collectively, the “Services”), and your use of WOO-branded electronic sensors and devices (the “Products”). By creating an account, downloading or using the Services, participating in competitions, or using a Product with the Services, you agree to these Terms.

If you do not agree, do not use the Services or Products.

1. Who We Are

The Services and Products are provided by Boards and More GmbH (“Boards and More”, “WOO”, “we”, “us”).

2. Eligibility and Account Registration

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who is responsible for your use.

You agree to provide accurate information when registering and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@woosports.com if you suspect unauthorized access.

3. Products, Compatibility, and Availability

Full use of the Services may require compatible Products, supported devices (e.g., mobile phone, watch), internet access, and software updates. We do not guarantee that the Services or any feature will be available at all times, in all locations, or on all devices, and we may modify, suspend, or discontinue features at any time.

4. Safety, Precautions, and Medical Disclaimer

The Services provide activity tracking and informational content. The Products and Services are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition.

Kiteboarding/kitesurfing and related watersports involve inherent risks of serious injury, death, and property damage. You are solely responsible for: assessing conditions, your fitness and skill level, equipment setup and inspection, and safe participation. Stop immediately if you feel pain, dizziness, or other warning symptoms and seek medical help if needed. If you have health concerns, consult a qualified medical professional before participating.

5. License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in connection with the Products.

You may not (except where permitted by law): reverse engineer, decompile, attempt to extract source code, bypass security controls, interfere with the Services, scrape data at scale, or use the Services for unlawful purposes.

6. User Content and Community Features

The Services may allow you to create, upload, or share content such as profile info, session notes, photos, comments, videos, or other materials (“User Content”). You retain ownership of your User Content.

6.1 License to Operate the Services

To operate and provide the Services (including social features, leaderboards, and competitions), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, publish, display, and distribute your User Content and related session outputs (including associated metadata) to the extent necessary to:

  • provide the features you choose (e.g., sharing and public profiles),

  • administer leaderboards and competitions,

  • operate, secure, and improve the Services, and

  • promote the Services only where you have made content public or separately agreed.

This license ends when you delete the relevant User Content, except where (a) it has been shared with others who have not deleted it, (b) it is required for legitimate business purposes (e.g., security logs, dispute resolution), or (c) we must retain it to comply with legal obligations.

6.2 Your Responsibilities

You represent that your User Content:

  • does not infringe third-party rights (including IP, privacy, publicity),

  • is not illegal, deceptive, or harmful,

  • does not contain malware or code designed to disrupt systems, and

  • complies with applicable law and any competition rules.

6.3 Moderation

We may remove or restrict User Content, or suspend accounts, where we reasonably believe content or conduct violates these Terms, applicable law, community guidelines, or competition rules.

7. Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. Please review it carefully.

8. Official Competitions

WOO may organize and operate official competitions (including online, in-app, and event-based competitions) (“Competitions”). Additional rules, eligibility criteria, scoring methods, anti-cheating requirements, prize terms, and sponsor details may apply and will be provided in the app, on the website, or as event rules (“Competition Rules”).

By entering a Competition, you agree to comply with the applicable Competition Rules. If these Terms conflict with Competition Rules, the Competition Rules control for that Competition.

We may verify, review, adjust, disqualify, or remove entries where we reasonably believe results are affected by sensor misuse, manipulation, falsified GPS, data tampering, rule violations, or other conduct that undermines fair play.

9. Fair Play and Anti-Cheating

Leaderboards and Competitions are intended to be fair and meaningful. Any attempt to cheat, including incorrect sensor placement, manipulation of captured data, falsified GPS, data injection, or other improper conduct may result in:

  • removal of jumps/sessions,

  • leaderboard exclusion,

  • Competition disqualification, and/or

  • suspension or permanent account ban.

We may take these actions at our discretion to protect the integrity of the Services and Competitions.

10. Third-Party Services and Integrations

The Services may integrate with third-party services (e.g., watch platforms, fitness apps, social platforms). If you connect a third-party service, your use of that service is governed by that third party’s terms and privacy policy. We are not responsible for third-party services, including their availability, accuracy, or data handling.

11. WOO Pro Subscription (Monthly / Annual)

WOO offers a paid subscription called WOO Pro (“WOO Pro”), available on a monthly or annual basis.

11.1 Billing and Renewal

If you purchase WOO Pro through the Apple App Store or Google Play, payment and renewal are handled by that platform. Your subscription will renew automatically unless you cancel before the renewal date. You can manage or cancel via your Apple/Google account settings.

If WOO Pro is purchased through another channel (if offered), billing terms will be shown at purchase and your subscription will renew as described there unless canceled.

11.2 Trials, Changes, and Price

If a free trial is offered, trial terms will be shown at sign-up. We may change WOO Pro features, pricing, or availability from time to time as permitted by law; for material changes, we will provide notice where required.

11.3 Refunds

Refunds are handled in accordance with the policies of the platform or channel where you made the purchase and any applicable law.

12. Intellectual Property

The Services and Products, including software, design, graphics, text, logos, trademarks, and all related materials, are owned by or licensed to Boards and More GmbH and are protected by intellectual property laws. Except for the limited license granted in Section 5, no rights are granted to you.

13. Feedback

If you submit suggestions or feedback, you agree we may use it without restriction or compensation (to the extent permitted by law).

14. Termination

You may stop using the Services at any time. We may suspend or terminate your account or access if we reasonably believe you have violated these Terms, Competition Rules, or applicable law, or if your use poses security, legal, or integrity risks.

Where reasonably possible, we will provide notice and an opportunity to address issues, except where urgent action is required (e.g., fraud, security incidents, or Competition integrity).

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or available at all times, or that any performance metric, leaderboard placement, or Competition result will be accurate in all circumstances. Sensor readings and GPS tracking can be affected by many factors, including device placement, conditions, and interference.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOARDS AND MORE GMBH AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR COMPETITIONS WILL NOT EXCEED THE GREATER OF:

(a) THE AMOUNT YOU PAID TO US FOR THE SERVICES (INCLUDING WOO PRO) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR

(b) EUR 100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including liability for death or personal injury caused by negligence, fraud, or mandatory consumer rights).

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Boards and More GmbH and its affiliates, directors, officers, employees, and agents from claims, liabilities, damages, and expenses arising out of your misuse of the Services, violation of these Terms or Competition Rules, or infringement of third-party rights through your User Content or conduct.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Austria, excluding conflict of law rules.

If you are a consumer in the EU/EEA/UK, you may benefit from mandatory consumer protections under the laws of your country of residence, and you may bring claims in the courts of your country of residence where permitted by law.

For business users, the exclusive place of jurisdiction shall be the competent court at Steyr, Austria (or other competent court determined by applicable Austrian procedural law).

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice via the Services or email. Continued use of the Services after changes take effect means you accept the updated Terms.

20. Miscellaneous

If any part of these Terms is held unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent; we may assign them as part of corporate restructuring, sale, or reorganization. These Terms, together with the Privacy Policy and any Competition Rules, are the entire agreement regarding the Services.

21. WOO Pro Subscription

This Section governs the WOO Pro paid subscription (“WOO Pro”) and supplements these Terms. If there is any conflict between this Section and other parts of the Terms, this Section controls with respect to subscription matters.

21.1 Subscription Overview

WOO Pro is an optional, paid subscription that provides access to additional features, functionality, analytics, insights, and/or content within the Services.

WOO Pro is offered on:

  • a monthly subscription basis, and

  • an annual subscription basis.

The features included in WOO Pro are described in the app or on the website at the time of purchase and may change over time.


21.2 Pricing and Taxes

  • Subscription prices are clearly displayed before purchase and may vary by region, currency, platform, and applicable taxes.

  • Prices include applicable VAT or sales tax unless otherwise stated.

  • Any price changes will apply only to future billing periods, subject to applicable law and platform rules.


21.3 Automatic Renewal

WOO Pro subscriptions renew automatically at the end of each billing period (monthly or annual) unless canceled at least 24 hours before the end of the current period, in accordance with platform requirements.

Your payment method will be charged automatically at the start of each new billing period unless you cancel.


21.4 Billing and Payment Processing

Billing, payment, renewal, and cancellation are handled by the platform through which you purchase WOO Pro:

  • Apple App Store: Purchases are managed by Apple and subject to Apple’s media services terms.

  • Google Play Store: Purchases are managed by Google and subject to Google Play’s terms.

  • Other authorized channels (if offered): billing terms will be presented at the time of purchase.

Boards and More GmbH does not store your full payment details for purchases made through third-party platforms.


21.5 Free Trials (If Offered)

If WOO Pro is offered with a free trial:

  • The trial duration and eligibility conditions are shown before you start the trial.

  • Unless you cancel before the end of the free trial, your subscription will automatically convert to a paid subscription and your payment method will be charged.

  • Only one free trial may be offered per user or account, where permitted by platform rules.


21.6 Managing and Cancelling Your Subscription

You can manage or cancel your WOO Pro subscription at any time through the platform where you purchased it:

  • Apple App Store: Account Settings → Subscriptions

  • Google Play Store: Payments & Subscriptions → Subscriptions

Cancellation takes effect at the end of the current billing period. You will continue to have access to WOO Pro features until that time.

⚠️ Important: Deleting your WOO account or uninstalling the app does not automatically cancel an active subscription.


21.7 Refunds

Refunds are handled in accordance with:

  • the policies of the platform where the purchase was made (Apple or Google), and

  • applicable consumer protection laws.

Boards and More GmbH does not issue refunds directly for purchases made through third-party app stores unless required by law.


21.8 Changes to WOO Pro

We may modify WOO Pro features, benefits, pricing, or availability from time to time.

  • Any material changes affecting your subscription will be communicated in advance where required by law or platform rules.

  • If WOO Pro is discontinued, you will retain access until the end of your current paid billing period, unless otherwise required by law.


21.9 No Guarantee of Results

WOO Pro provides enhanced tracking, analytics, and comparison tools.

We do not guarantee:

  • performance improvements,

  • leaderboard positions,

  • competition outcomes, or

  • specific results of any kind.

All metrics, analytics, and rankings depend on multiple factors, including conditions, equipment setup, sensor placement, GPS accuracy, and user behavior.


21.10 Suspension or Termination

We may suspend or terminate access to WOO Pro without refund if:

  • you materially breach these Terms or Competition Rules,

  • you engage in cheating, fraud, or abuse of subscription features, or

  • suspension or termination is necessary to protect the integrity, security, or legality of the Services.

This does not affect any mandatory rights you may have under applicable law.


21.11 Consumer Rights

Nothing in this Section limits or excludes mandatory consumer rights available to you under applicable law in your country of residence, including EU consumer protection laws.
